Public Offer

1. General Provisions

  1. This public offer agreement (the “Agreement”) is entered into by the sole proprietor Monina Olena Oleksandrivna, acting on the basis of a registration extract, TIN 2340913003, physical address: Kyiv, Shalimova St. 10, 2nd floor (the “Contractor”), and any individual or legal entity that accepts the terms of this offer (the “Customer”).
  2. The Contractor provides rental and sale services for items, including carnival costumes, dresses, wings and other accessories (the “Items”).
  3. By accepting this offer, the Customer confirms their agreement with the terms of the Agreement and undertakes to comply with all of its provisions.

2. Rights and Obligations of the Parties

  1. Contractor’s obligations:

    1. Provide the Items for rent within the agreed timeframes, clean and free of defects. If any defects exist, the Contractor must inform the Customer in advance.
    2. Enable booking of the Items via phone, social networks, the website, or messengers.
    3. Allow in-store fittings during business hours at: Kyiv, Shalimova 10, 2nd floor.
    4. Assist during fittings with putting on the Items and provide usage instructions for each Item.
    5. Booking is considered confirmed upon payment of the booking service and the Contractor being informed of the payment.
  2. Customer’s obligations:
    1. Return the rented Items within the agreed period, without delay and without damage (holes, tears, etc.). If damage caused by the Customer is detected, a fine is charged, calculated individually depending on the nature of the damage and the repair cost.
    2. Attend fittings without makeup or perfume, with a neutral body odor, and without cream self-tanners. If these conditions are not met, the Contractor may reschedule the fitting and refuse to conduct it.
    3. Fittings are free of charge.

3. Prices and Payment

  1. The rental prices and service fees are listed on the website. For additional custom requests, the price is determined individually depending on the order and agreed with the Customer in advance.
  2. Payment may be made in cash, to a bank account, or via payment systems.
  3. For remote bookings, the Contractor is not responsible if the Items do not match the Customer’s color or size expectations. The Contractor’s manager clarifies all parameters before shipment and selects appropriate Items. If the Items do not fit, the payment is non-refundable.
  4. When booking in person or online, the Customer pays the rental fee. A security deposit is paid upon receipt of the Items or before the courier ships them by post.

4. Rental and Return Terms

  1. The rental period may be extended upon prior agreement with the Contractor, subject to Item availability. The extension fee is 50% of the daily rental price for each additional day.
  2. The Customer may reschedule a booking once without losing the prepayment, provided this is done no later than 48 hours before the planned date and the Items are available on the new date.
  3. If the Customer cancels less than 72 hours before the agreed date, the prepayment is non-refundable. If the cancellation is more than 72 hours in advance, the prepayment is refundable.
  4. If the return deadline is violated without prior agreement, the Customer pays a penalty that includes the daily tariff (i.e., 50% of the rental price for each day of delay).
  5. Taxi costs and postal shipments both ways are paid by the Customer.
  6. You may pick up a costume at the store on the day before your event after 14:00. It must be returned on the day of the event or the next day by 12:00. In December, costumes must be returned on the day of the event by 20:00. If you cannot meet these times, you must inform us in advance, as other bookings may follow and the costume is sent for cleaning.
  7. When renting with delivery via Nova Poshta (within Kyiv or to another city), the rental price increases by 50%. Nova Poshta services are paid by the customer. You can return the costume using Nova Poshta’s “Easy Return” service — in that case, the return is free. The costume is shipped two days before the event. It must be shipped back on the day of the event. For example, if your event is on the 10th, we will ship on the 8th, and you ship it back on the 10th in the evening after the event.

5. Damage and Item Return Conditions

  1. Prohibited:

    • hemming or shortening the costume yourself;
    • washing the costume yourself;
    • photo/video shoots with candles or wax.
  2. Damage compensation:
    1. Manufacturing defects: e.g., a split zipper, seam, or a twisted cup. Such defects are fixed by the Contractor at their own expense.
    2. Damage caused by the Customer: e.g., a heel hole, mechanical damage, traces of smoke bombs or sparks from a fire, paint. The repair cost is borne by the Customer and calculated individually.
  3. If the costume has ordinary stains (e.g., dusty hem, small tear traces from a crying child), we will remove them ourselves — no extra charge. If the stains are hard to remove and an additional dry-cleaning is required, you pay the dry-cleaning cost.
  4. Only steaming with a garment steamer is allowed. Using an iron is prohibited.

6. Termination and Dispute Resolution

  1. The Contractor may terminate this Agreement if the Customer fails to appear to collect the booked Items at the agreed time without prior notice to the Contractor.
  2. All disputes arising out of this Agreement shall be resolved through negotiations or an official notice to the Contractor, or in court if the previous methods do not yield results.
  3. If the Customer has any claims regarding the services provided, they must notify the Contractor within 24 hours after receiving the services. Claims regarding the quality of the Items may be made before signing the receipt document; after signing, claims are not accepted.

7. Final Provisions

  1. This Agreement comes into force upon the Customer’s acceptance and remains effective until the Parties fulfil their obligations.
  2. Any amendments and supplements are made by mutual consent of the Parties and in writing.
  3. This Agreement is drafted in Ukrainian and governed by the laws of Ukraine.
